1. About Us

CuratorSpace Ltd (“we”, “our”, “us”) operates the websites CuratorSpace (www.curatorspace.com) and Exhibtd (exhibtd.com). Buyers (“you”, “your”) access Exhibtd to browse and purchase artworks listed by artists and sellers.

Exhibtd provides an online marketplace where buyers can purchase artworks directly from artists. CuratorSpace Ltd provides the platform only. We are not a seller or agent of the artworks listed.

By using Exhibtd to purchase an artwork, you agree to these Terms and Conditions.

2. Buying Artwork

  • When you purchase an artwork through Exhibtd, you enter into a contract directly with the artist (the “seller”).

  • Exhibtd is not responsible for the quality, description, authenticity, availability, legality, or suitability of the artworks listed.

  • All product information, prices, terms of sale, and returns policies are provided by the seller.

3. Payments

  • Payments are processed securely through our payment services provider.

  • A processing fee is added at checkout and displayed before you complete your purchase.

  • Exhibtd holds funds until the seller confirms dispatch and provides valid tracking information. Funds are then released to the seller.

4. Shipping and Delivery

  • Sellers are solely responsible for packaging, shipping, delivery times, insurance, and any customs requirements.

  • Delivery details and charges are shown in each artwork listing.

  • Risk passes to you once the seller dispatches the artwork.

5. Cancellations, Returns and Refunds

  • Exhibtd does not manage cancellations, returns or refunds.

  • Each seller provides their own returns and refund policy in the “Legal Information” section of the artwork listing.

  • Any requests for cancellation, return, or refund must be made directly to the seller.

  • Nothing in these Terms affects your statutory rights under UK consumer law.

  • Processing fees are non-refundable, except in the event of non-delivery, damage, or where items significantly differ from the artwork listing.

6. Disputes

  • Disputes relating to a purchase must be resolved directly between you and the seller.

  • Exhibtd may, at its discretion, assist with communication between you and the seller, but we are not obliged to resolve disputes and accept no liability for them.

7. Listings and Content

  • All information in artwork listings is the responsibility of the seller.

  • While we moderate shopfronts and listings before they appear on Exhibtd, we do not guarantee accuracy, completeness, or reliability.

  • If an artwork does not match its description, your rights are against the seller directly.

8. Intellectual Property

  • Copyright and intellectual property rights in artworks remain with the artist unless otherwise stated in the listing.

  • By purchasing an artwork, you acquire ownership of the physical item only. No reproduction rights are transferred without the artist’s prior written consent.

9. Limitation of Liability

  • Exhibtd is not liable for:

    • the quality, condition, description, authenticity, or suitability of artworks,

    • delays, damage, or non-delivery,

    • any errors or omissions in listings,

    • disputes between buyers and sellers.

  • Our total liability to you will not exceed the amount you paid for the artwork in question.

  • Nothing in these Terms excludes liability for death or personal injury caused by negligence, or fraud.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
